Penalties for DUI in South Carolina

Penalties for DUIs in South Carolina are very fact specific.

For a first offense, the fine can range from $400 to $1,000 depending on the circumstances. You can also face jail time from 48 hours to 90 days.

For a second offense, fines can be $2,100 to $6,500 and jail from 5 days to 3 years.

For a third offense, fines of $3,000 to $10,000 and jail time ranges from 60 days to 5 years.

For fourth and subsequent offenses, jail time ranges from 1 year to 7 years. 

These numbers do not include attorney’s fees. Attorney’s fees vary on a case by case depending on the facts. Simple DUI charges, without injury or death, are generally misdemeanors. These numbers outlined below are NOT for felony DUI cases including DUI causing great bodily injury or DUI causing death. Some third and subsequent offenses can also be felonies. DUI convictions cannot be expunged.
